Rip-off DKNG Wheels deck

soooo... I came across this deck from a supposed designer that states he originally created the cards for his company but they're obviously ripped off designs from DKNG's Wheels; so, I commented on how similar they looked and tagged DKNG Studios & art of play and within minutes, the IG has been deleted but his name is Chris Caldwell (IG 'chriscaldwell90') and this is the link to where he's selling these knockoffs :

I seriously can not for the life of me understand why a designer would sink so low - like it's only a matter of time before the truth comes out and how humiliating must that be when it does - like why even risk it?!?

Pretty lame :? though I am sure he will say his is different because the spades and clubs are skeletons instead of people and the color scheme is different, but it is clearly a copy :evil:

Can somebody do a side-by-side? They don't look that much alike to me, aside from the bicolor pips (which many have done), but I may not be looking at the right Wheels deck for comparison.

Besides the most obviously noticeable difference in the skull heads on the courts of the Spades & Clubs, I'd say, that from only the few cards that are shown, the courts of the Diamonds look to have the most variance from the original source material as he took a bit more liberty in changing them up - even if only slightly. But many of the others are just simple & minor changes in the linework, most particularly in the courts attire and slight mods to their features; for example, removal of the KoH's beard - but overall, the fundamental design work is pretty dang spot on IMHO and I think the similarities are much too close to ignore... :?

The "designer" must of also thought so too and knew he got caught in so quickly shutting down his IG after I commented on the similarities... I just don't understand how he would've thought that no one would notice considering how popular the Wheels decks are... :? :roll:

Similarities don't equal rip-off. They're completely different designs. Leave it to Amy to push a future designer away by having them shutdown their IG account because they got "caught".

First off, I wrote literally one comment on his OPENLY PUBLIC IG stating that they looked similar; something along the lines of "wow - those look great but also a lot like @dkngstudio's Wheels deck they designed for @artofplay." I didn't delete his IG nor even suggest that he do so - he did that all on his own - so how can you possibly hold me responsible for his or anyone else's actions??? :roll:

And I think it's only socially responsible to make others aware when their designs seem awfully close to someone else's work because if he was only "inspired" by another's work as it seems he obviously was in designing this deck, he should give credit where it is due to the original illustrators that came up with the concept and created the designs to avoid copyright infringement; but instead of defending his work and being open to discussion, he chose to immediately shut it down as if he was trying to hide my comment and his work from anyone else taking notice, which seems kinda suspicious, don'tcha think?? :? :roll:

oh, and fyi: "rip-off" means inferior imitation, ie. similar - so yea, similarities can equal rip-off as I do believe this deck is proven to be; I was very deliberate in NOT calling these designs a copy as it's obviously NOT an exact copy and even went as far as to point out & credit the designer's effort (although very minimal) for the minor difference he did happen to make in the linework as seen with side-by-side comparisons I provided, but anyone with eyes can see that even with small elements added/removed/changed, there's some very, VERY strong resemblance between the two designs that I personally find VERY hard to fathom that the two deck designs just so happen to have been created completely by coincidence... :roll:

Please, folks, let's disagree but *without* the personal attacks, okay? Hmmm?

Speaking as someone who used to run a print shop and therefore did graphic design work every day for years, I can safely hypothesize that is it MUCH more likely that one of these is a modified version of the other, rather than these being two independently-created designs that resemble each other strictly by coincidence. I acknowledge that it's *possible* that it's a coincidence, but really, that's the least likely explanation for the similarities.

Your mileage may vary.

I am not entirely sure it's a wise move to get in the middle of this boisterous exchange, but in the spirit of honest enquiry:

Isn't almost all art derivative ? Based on... inspired by... in the style of... ...esque, school of... homage to... parody of... on the theme of...

Yes, there are obvious similarities between the decks, but some very obvious differences as well. If one re-colours a "standard court" light-blue, is it a rip-off of someone else's sky-blue re-colour ? Just about all court cards are identifiably playing cards in style, otherwise they would not be useable as such - are they all rip-offs ?

If one uses elements of another's work, does simply acknowledging it make everything OK (that's my inference from PipChick's comment) ? Or am I forever banned from using burgundy heart pips because someone else liked that particular colour before me ? Does Randy Butterfield own the copyright on hexagonal repeated pattern backs because he came up with Honeybees, or can Ellusionist stop worrying about being stung by Bumble Bees, Killer Bees and Super Bees ?

I am no expert, but looking at the two decks in question, it's obvious that one was "based on" the other, but so many changes were made that I think it became a new design, albeit one lacking in much creativity.

And finally, if you are going to criticise anything involved here, surely it should be the corporate bollocks and management-speak of the website advertising the designer's work. That's the real blight on humanity and the wheel on which my soul is broken.

Okay, so, I just clicked the link on PipChick's post. These are my thoughts:

I really like the DKNG Wheels deck, I also like this deck, but that's because it is a VERY OBVIOUS DIRECT QUOTATION of Wheels. Immediately this fact jumps right at the viewer with the pictures of the tuck. I wish the DKNG deck had done the whole matte tuck with gold foiling/ink that this guy did, that looks boss with this style of art. Having said that, I don't know if I would feel comfortable supporting this artist's project unless they at least bothered to reference Wheels as an inspiration/reason for doing their own interpretation. But, it's almost like they were going for obviously similar, close enough you'd have to have a side-by-side to tell the difference between the two, but having changed enough that it avoids being what could legally or technically be considered a copy.

Unless this Caldwell character was a staff designer at DKNG, and involved somehow in the development of the Wheels design?

Maybe DKNG will produce a tuck like that one.

BTW, did anyone see the DKNG mini deck? I was thinking about getting one.

The only thing that looks good about this deck is the number pips. The pips on the courts doesn't match with the number pips. black & yellow backs doesn't compliment the color of the tuck and the back design of the tuck should be on front or at least a skull on the front tuck. This deck is all wrong.
