Regardless of whether or not I like the deck I'm not sure about copyright infringement here?

Re: Dinastia Playing Cards
Even having two portuguese players depicted there I can't pull the trigger.
The box and the back don't fit in the overall design, not only that but the box and back by themselves are weak to say the least.
Good luck with the project nonetheless, it looks ok, and it is priced just right (something we have not seen lately)

I have to disagree. I think that the back design is clean and fits the futbol/soccer theme well.sms69x wrote:Even having two portuguese players depicted there I can't pull the trigger.

You are right, that these are priced fairly.
I'm going to consider backing these.

Thanks! We do care about the price of the decks being as low as possible.
We hope the work that was put into the design gets noticed, we will be updating with more info on the deck.

If I drive down to San Ysidro can you just throw the brick box over the fence to save on shipping?
I'm in for a deck, I like the back design and the art on the courts. I'm undecided about the tuck box and the font used for the indices, though.

Re: Dinastia Playing Cards
The issue here isn't copyright, but rather trademarks. Obviously every football uniform is trademarked by the club/nation that owns or sponsors them. Additionally, most uniforms have additional sponsorships and branding that is further trademarked, such as from Adidas or Nike or FIFA, for example. If you are going to draw or paint athletes in their official uniforms, and use that art in a commercial manner, you must obtain licenses in order to have permission to legally market and sell your playing cards.dinastia futbol wrote:Hi, we are not using any image that has any copyright. So the question is whether your art is close enough to the real thing to constitute an infringement? Let's take the Jack of Spades/Messi card as an example. When I see that card, it is an almost identical representation of the colors and graphics of the Argentine national team uniform. Even the AFA logo and Adidas logo on Messi's chest are recognizable. It seems like your defense is going to be, "Well, the logos or brands aren't being represented directly, or they're too blurry, so it's OK." As an attorney, I would hate for that to be the basis of my legal defense against a trademark infringement lawsuit where the potential penalty is in the $100,000.00's. I think you're very close to the line of trademark infringement, if not over, and that's a bad place to be because it puts you at some degree of risk. Personally, I would remove the team logo patches and Adidas logos off of the chests of all the players just to be safer. Or at least make them even more indistinct.
The other question is whether you even care, even if there are trademark violations going on here. Ultimately your best defense may be that you're way too small potatoes to attract the attention of an IP lawyer representing any national team or Adidas to raise a challenge in court. While I wish you success in your KS campaign, I doubt you're going to make millions of dollars (U.S.) from the sale of these playing cards, which further reduces any chance of "getting caught", so to speak.

Re: Dinastia Playing Cards
Merged the duplicate threads.
On the terminology issue: "Soccer" is actually a shortened nickname derived from its actual name "Association Football", to distinguish it from "Rugby Football" (which was similarly called "Rugger" at one point). This information can be used to argue both for and against using the term over just "football". For me, soccer is the sport that most fits the name "football", and I can't see any logical reason to why a sport where the ball is mostly carried/thrown should have that name. But that's just, like, my opinion, man

Re: Dinastia Playing Cards
Tom, apperantly Americans call American football football because the ball is a foot-long.
Not sure if that is true or not, but a random guy said it to an another random guy behind me in a football game yesterday and I'm too lazy to check for myself.

Re: Dinastia Playing Cards
From my notes...
Football is far and away the oldest term, first recorded in a law of King James I of Scotland in 1424 which laid down that any player of the game was to be fined 4 pence. It did not, however, begin to become the modern game until the foundation in 1863 of the Football Association, which duly laid down the rules of what had hitherto been a somewhat rough-and-tumble game. The term soccer is taken from the -soc- part of Association, although it may be reinforced, judging by such early spellings as 'socker' with 'socking' or kicking the ball. In either case the word, like the colloquial modification of rugby as rugger, uses the 'Oxford' -er suffix, which also emerged in the 1890s. Football was similarly modified as footer, usually in British public (i.e, elite and private) schools, but is now wholly archaic.
The first recorded use of football in reference to the US game is in 1881, when on 20 Nov. the N.Y. Herald reported that
'A splendid game of football was played yesterday at the Polo Grounds between [...] Harvard and Princeton.'
Soccer's popular emergence in the US is a relatively recent phenomenon, and in American eyes the homegrown game is the 'real' football. Thus the need to use soccer as a means of differentiating the two styles of play. Of course the rest of the world, who do not play US football, would propose the opposite view.

This project isn't going to fund.
American Football, and soccer, are both boring as hell to watch. "Futbol" is fun to play, though.

Re: Dinastia Playing Cards
Hi guys
So yeah for some reason this project its not working and we wish we could understand a little better why.
Besides all the "trademark" and confusion between futbol and soccer, what do you guys think was the thing that didnt make you a backer?
Was it the name? The overall design? the color? or the theme?
I would appreciate all the help that we can get to create better future projects
Thanks!

I don't like the lions on the back. Living in US I don't watch international football (soccer) until World Cup or our national team playing so I have no clue who the 12 men are.dinastia futbol wrote:Hi guys

Re: Dinastia Playing Cards
I really like the overall idea and think the court artwork is great. Not exactly sure why funding has been so low thus far but here are my thoughts...
There is lots of color on the courts with the different team jerseys but the back and tuck are just black & white; as pointed out by sms69x earlier. It might have been good to incorporate some color there in those.
Also, like RichK, I'm not a fan of the lions...and the name too. It kind of makes it sound/look like a club team name & logo instead of something that represents all of the great players around the world. I don't mind the rest of the back design though (besides the lack of color).
I am a casual soccer/football fan and grew up playing here in the US. Because of that, I was leaning towards pledging because there is a lack of good quality soccer/football decks. I just have not pulled the trigger yet; mostly based on what I have mentioned. I still may do so...really like that it is Cartamundi B9 and price point is not bad at all.
I wish you luck with this and future projects.

Re: Dinastia Playing Cards
We've all seen these kinds of ideas executed horribly and they hurt just to look at.
The design on these, though, is really well done. Kudos to the artists.
